Breaking And EnteringBreaking and entering is defined as the crime of illegally entering a residence or other enclosed property using any amount of force (even pushing open an unlocked door). If criminal intent can be established, breaking and entering can be considered a burglary, a felony in most U.S. jurisdictions. If there is no criminal intent, breaking and entering can be considered trespassing, which is usually a misdemeanor crime.
